By downloading, installing, accessing, or using the SmartTracker app (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App. Your continued use of the App indicates your acceptance of these Terms.
These Terms apply to all users of the App across all supported platforms: iOS, iPadOS, and macOS.
SmartTracker is a data tracking tool designed to help users record, monitor, and analyze numeric information—such as numbers, currencies, and percentages—over time. The App enables users to input data items of interest, store and update their values, and review value changes or trends using features provided within the App.
The App is provided as a service by Hugo Prione Duarte (“Developer,” “we,” “us,” or “our”).
License Grant:
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial purposes.
Intellectual Property Rights:
All content, features, functionality, design, graphics, text, and other materials of the App are the exclusive property of Hugo Prione Duarte and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material in the App, except as necessary to use the App for its intended purpose.
No Commercial Use:
You may not use the App for any commercial purpose or in any way that violates these Terms or any applicable laws or regulations.
AS-IS BASIS:
THE APP IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. THE DEVELOPER MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES, EXPRESS OR IMPLIED, REGARDING THE APP, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
NO GUARANTEE OF ACCURACY:
While efforts are made to provide reliable data tracking and analysis features, we do not guarantee:
- The accuracy, completeness, or timeliness of values recorded in the App.
- That the App will function error-free or uninterrupted.
- That defects in the App will be corrected.
- That the App will meet your expectations or requirements.
YOUR USE AT YOUR OWN RISK:
Your use of the App is at your sole risk and discretion.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HUGO PRIONE DUARTE BE LIABLE FOR: - Any indirect, incidental, special, consequential, or punitive damages. - Loss of profits, revenue, data, or business opportunities. - Damages arising from your use of or inability to use the App. - Damages arising from unauthorized access to or alteration of your data. - Any other damages related to your use of the App.
MAXIMUM LIABILITY:
To the extent applicable law permits, the maximum total liability of the Developer for any claim arising from or relating to these Terms or the App shall not exceed the amount you paid for the App (if any).
These limitations apply regardless of the legal theory on which the claim is based, whether in contract, tort, strict liability, or otherwise, and whether or not the Developer has been advised of the possibility of such damages.

The Developer reserves the right to: - Modify, update, or enhance the App and its features at any time. - Discontinue the App or any of its features, with or without notice. - Change pricing or introduce new pricing models. - Modify these Terms and Conditions.
Continued use of the App following any changes constitutes your acceptance of the modified Terms.
You agree not to: - Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or internal workings of the App. - Create derivative works or modifications of the App. - Circumvent any security or access control mechanisms. - Use the App or its components in any way not explicitly permitted in these Terms.
Violation of these restrictions may result in legal action and termination of your license to use the App.
The Developer reserves the right to terminate or suspend your license to use the App at any time, with or without cause or notice. Upon termination, your right to use the App immediately ceases.
These Terms and Conditions are governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Brazil.
Users outside Brazil acknowledge that they are subject to Brazilian law for any disputes with the Developer.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements, understandings, and negotiations, whether written or oral.
The failure of the Developer to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by the Developer.

The App does not integrate with third-party services (other than Apple's iCloud). You are solely responsible for your agreements with Apple and your use of Apple services. The Developer is not responsible for any third-party services or their terms.
The information provided by the App and the ability to track numeric values are for informational purposes only and do not constitute financial, investment, or professional advice. Do not rely solely on the App for decision making. Always carry out your own verification when using tracked values for important purposes.
You are responsible for: - Maintaining the security of your device and iCloud account. - Keeping your operating systems and apps updated. - Backing up your data independently. - Your use of the App in compliance with these Terms and all applicable laws.
By using SmartTracker, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
